A serial car fraudster was today arraigned before Milimani Law Courts facing charges
A serial car fraudster was today arraigned before Milimani Law Courts facing charges of obtaining money by false pretences contrary to the Law.
The suspect, Isaac Chetambe Chesoni was charged that on diverse dates between December 4 and 5th 2023 at unknown place within the republic of Kenya, with intent to defraud obtained Ksh 451,000 from Everlyn Akinyi pretending he would facilitate purchase of a motor vehicle a fact he knew to be false.
At the time of his arrest, the motor vehicle alleged to have been used to dupe the complainant to initiate the transaction was also detained by the police.
Appearing before Magistrate Benmark Ekhubi, the accused denied the charges and was released on Ksh 100,000 bond.
His lawyer attempted to move the court seeking to have the impounded car released alleging that by the time the charge sheet was drafted, the motor vehicle in contention was not indicated although the identity of the car was well-known.
The lawyer informed Court that the suspect has been driving the car all along and it was not seized by police nor indicated as an exhibit.
She said that the police took advantage of the warrant of arrest by impounding the vehicle moments after arresting the suspect.
However, the prosecution objected to the accused person’s application to have the car released stating that it was used to obtain money fraudulently.
The court directed the accused person’s lawyer to file a formal application seeking to have the impounded car released from the police.
