Kisii Politician Faces Fraud Charges Over Sh1.6 Million

A politician from Kisii has been charged at a Nairobi court with conspiracy to obtain Sh 1.6 million by falsely pretending to be in a position to execute a court order from Mavoko Law Court.

Credius Nyamwange Oigara who was contesting for the Bomachoge Parliamentary seat was charged alongside Kenneth Korir who did not appear in court with the offence of conspiring to defraud a trader James Njukia Ihura the said money.

The prosecution told the court that on diverse dates between April 13 and April 15 2023, in Nairobi county the duo conspired to defraud Ihura who is trading as Manyota Investment Limited by pretending that they were in a position to effect an eviction order issued by Mavoko Law Court regarding the case E057/2022 a fact which they knew was false.

Separately, Oigara was charged with obtaining money by pretences contrary to section 313 of the Penal Code and posing to be an advocate of the High Court.

The court heard that Nyamwange obtained sh 1,600,000 from Ihura on diverse dates between April 5 and 15 2023.

To accomplish his mission, the prosecution told the court that Oigara jointly with another who was not in court posed as an advocate of the High Court on April 5.

He appeared before the Milimani senior principal magistrate Benmark Ekhubi and denied the charges.

The prosecution did not oppose his release on bond.

The defence prayed for leniency citing that his client is a known public figure who is not a flight risk,

“My client is a known public figure and his residence is known hence praying his release on lenient bond terms,” the defence prayed.

He was released on a bond of Sh 500,000 with a surety of a similar amount or alternative cash bail of Sh 300,000 with one contact person.

The magistrate further released a warrant of arrest against Korir who failed to appear in court for plea taking.

The matter will be mentioned on October 15, 2024, for pre-trial and directions.

At the same time, two businessmen were charged with conspiring to defraud proprietors Mwangi Irungu Weru and Assumptah Wanjiru Weru a parcel of land worth Sh 35 million located in Karen within Nairobi county by pretending that the said parcel was a donation to them by Philip Mule Kilonzo which was a false fact.

Sarone Ole Riamet jointly with Emmanuel Leneiloi Naenkop obtained Sh 12,000,000 from John Walker Wakhanu by falsely pretending they were in a position to sell him a parcel of land LR No 13872/8 located in the Karen area within Nairobi county.

They denied the charges and were released on a bond of Sh 2 million.

The matter will be mentioned on October 15, 2024.
